Information on tour operator liability for associations

As an association, they are also considered tour operators if they offer and organize at least two typical travel services. These include, for example, transfers, entrance tickets, accommodation and catering as well as tours. In this case, the association is liable for all damages that the contracted service providers (bus company, hotel, restaurant, ...) cause to the participants of the trip. Information and benefits of the annual insurance

The trip cancellation insurance for individuals, couples and families including corona disease not only covers the cancellation costs of the trip, it also includes travel assistance.

Who is this insurance for:	Individuals, couples, families*
Number of trips:	For one or more trips within a year
Closing date:	No later than 30 days prior to the start of your trip. If the start of your trip is less than 30 days in the future, you can still purchase insurance 3 days after booking your trip.
Max. Age of trip participants:	No age limit, however, the date of birth must be provided for each person
With or without travel cancellation insurance:	Travel Cancellation Basic Coverage: Travel Cancellation Insurance (with deductible only) Travel Cancellation Full Coverage: Travel Cancellation Insurance and Travel Curtailment Insurance (with or without deductible).
incl. Corona benefits:	Cost coverage in case of personal quarantine and/or COVID-19 illness**.
Max. Total travel price of the trip in Euro:	For a single person max. 10,000 euros For couples and families max. 12,000 euros
Deductible (only for plans with deductible):	The deductible in each claim is 20% of the eligible loss, minimum 25 euros per person.

* Definition of couple and family tariff: A couple or family tariff applies to a maximum of two adults (regardless of relationship and residence) and children up to their 21st birthday. Own children can be insured in any number, otherwise a maximum of six children can be insured. All insured persons must be listed by name in the insurance policy.

** A personal quarantine is an order by a public authority to restrict your whereabouts because you have come into contact with a contagious disease.

Corona Benefit Exclusions: No coverage is provided in the event of a quarantine order that applies generally to part or all of the population, to an entire vessel or to an entire geographic area. No coverage is also provided in the event of a quarantine order issued because you have previously traveled to or come from a specific location.

for all measure carriers and institutions from the areas of youth, culture, education, leisure and other non-profit clubs, associations, foundations & organizations
according to travel contract law, all clubs, associations and other organizations are also liable for personal injury, property damage and financial losses incurred by travel participants as a result of their activities as tour operators

What events are insured?

Liability insurance for tour operators provides coverage for the following events:

personal injury, such as death, injury or damage to health
Property damage, such as damage to or destruction of property belonging to the travel participants
pecuniary losses for the tour operator, such as those incurred in the processing of the travel registration
pecuniary loss for the travel agent , e.g. in the event of breach of duties of care and duty to provide information

When does tour operator liability insurance cover you?

Who is considered a tour operator?

According to the travel contract law §651 a Abs (2) Ziffer 1 BGB (German Civil Code), one is considered a tour operator if one offers two or more tourist services for a package tour. Day trips that last less than 24 hours, do not include an overnight stay and do not exceed a price of 500 euros are not subject to travel law.

As independent tourist achievements are considered after § 651a exp. (3) BGB among other things:

the management of the group
the rental of sports equipment (such as snowboard equipment)
excursions
city tours
sports events
tickets for events
the trip itself (bus, train, ship, flight)
the accommodation

If you accept the registration for an advertised trip and collect the travel fee, if you are acting as a travel agent, you should make sure to mention the tour operator in the travel description.

Note: If more than 1,000 travel participants are registered in a calendar year, a discount of 20% is granted on the participant fees.
