According to the travel contract law §651 a Abs (2) Ziffer 1 BGB (German Civil Code), one is considered a tour operator if one offers two or more tourist services for a package tour. Day trips that last less than 24 hours, do not include an overnight stay and do not exceed a price of 500 euros are not subject to travel law.
As independent tourist achievements are considered after § 651a exp. (3) BGB among other things:
- the management of the group
- the rental of sports equipment (such as snowboard equipment)
- excursions
- city tours
- sports events
- tickets for events
- the trip itself (bus, train, ship, flight)
- the accommodation
If you accept the registration for an advertised trip and collect the travel fee, if you are acting as a travel agent, you should make sure to mention the tour operator in the travel description.
Note: If more than 1,000 travel participants are registered in a calendar year, a discount of 20% is granted on the participant fees.
